Chief Justice of India Sanjiv Khanna expressed dismay at the increasing trend of civil disputes being transformed into criminal cases in Uttar Pradesh, labeling it as an “absurd” phenomenon that signifies a breakdown in the state’s law enforcement mechanism. The observation was made during a hearing involving Debu Singh and Deepak Singh, who were contesting a decision by the Allahabad High Court to uphold criminal charges against them.
The two individuals, initially embroiled in a cheque bounce issue, were unexpectedly confronted with serious criminal accusations like breach of trust, intimidation, and criminal conspiracy. Their legal representative argued that resorting to criminal charges was a strategic move to expedite resolution due to the prolonged nature of civil litigation.
In response to the situation, the Chief Justice, along with Justices Sanjay Kumar and K.V. Viswanathan, temporarily halted the criminal proceedings against the duo but allowed the cheque bounce case to proceed. Chief Justice Khanna emphasized the need for investigating officers to justify their decision to elevate civil matters to criminal offenses during trial proceedings.
The court mandated the Director General of Police and the investigating officer to submit detailed explanations within a fortnight regarding the escalation of the case against Debu Singh and Deepak Singh. The hearing was adjourned until May 5 to review the provided justifications.
